According to 2017 dog bite statistics, thirty-nine people in the United States died as the result of a dog attack. The pit bull breed was responsible for 74% of those deaths, although this particular breed makes up only 6.5% of the total dog population in America. Most children who are bitten by a dog are bitten by their own family dog, or a neighbor’s dog, and are generally bitten in the face or head.

Statistics show that the most vulnerable groups are children and older adults as far as dog bite fatalities are concerned. California Dog Bite Statute

Under California Civil Code § 3342, a dog owner is liable for damages suffered by any person bitten by the owner’s dog while:

  • In a public place;
  • Lawfully in a private place, and
  • On the property of the owner of the dog—so long as the person is legally there.

This is true regardless of whether the dog has a history of vicious behavior and whether the owner was aware of that vicious behavior, as some states require. The victim is only required to show he or she was bitten by the dog with no provocation—that is, the person was not teasing the dog or being mean to the dog.

Strict Liability for Dog Bites

Under California’s dog bite statute, the victim of a dog bite is not required to prove negligence on the part of the owner of the dog to recover compensation. California is a strict liability state. This means that the owner is liable even if he or she was unaware of the dog’s propensity for aggressive behavior.

Statute of Limitations for Dog Bites

Under the California Code of Civil Procedure 335.1, you have two years from the time of the dog bite in which to file a personal injury claim. This is known as the statute of limitations.   • Nearly half of all the fatalities in 2014 were children, ages 13 and younger. Of the adults killed by dog attacks in 2014, 73 percent were fifty years or older.
  • Fatal dog attacks increased 82 percent from the 1980s to 2012.
  • Overall, there are more female victims of dog bites and dog bite fatalities than male victims.
  • In more than half of all dog-bite fatalities in 2014, more than one dog was involved. Eight of the fatalities involved a pack of dogs (four or more).
  • Nearly a quarter of the 2014 fatal dog bite attacks resulted in criminal charges.
  • More than a third of all homeowner insurance liability claim dollars paid in 2012 ($489 million) were the result of a dog bite.
  • State Farm paid out for more than 3,550 dog bite claims in 2010, with an average payout of $25,714.
